View Full Version : I want to sell my taser. Is that illegal.

I want to touch bases with the mods before posting.

This is one of the disclosures regarding it's carry in some states:
"TASER® energy weapons are not considered firearms — they're legal to carry in most states without permits (including California). Restricted from citizen use in MA, RI, NY, NJ, WI, MI, HI and certain cities and counties."

It's tricky in this case, because of the nature of this item. Furthermore, legality depends on location. I would say it'd be OK, but suggest you added a disclaimer such as:
"Buyer must comply with local laws regarding legality of this item..." or something like that may be in order.

...but, let's hold until a more senior mod/admin gives their final word.

I agree with greenLED.* As long as it is legal in some parts of the U.S. then you should be able to post it for sale (as long as you post a disclaimer notifying the buyer to be fully aware of the legality of owning said item in his/her area).* I'm not "senior" by any means but that is my opinion.* Perhaps Todd or one of the Admins will let us know what to do.* :)

The truth is I have no idea what the Law is on this. *I have no problem with it as long we it breaks no laws. *I wonder if any of our members are versed in the law on this. *It would be my guess that the sale would have to be limited to those states that have no restrictions on it.

I hope someone that knows the law can chime in. *Or look of some reference to the law.

I won't post until this is becomes a clearer. I too feel that it is alright to sell it as long as it is sold the restricted areas posted above.
Think of it more closely related to pepper spray rather than a firearm.

Hello DH

I would say NO....Im not a Mod. But by the rule on B/S/T from EDC Forums
Rule # 10 and # 11 say everything...I know this is NOT a Fire arm but it will
fit on Rule # 11.

And Plus , why get in trouble for such thing ?
Well that is what I think.

DH, go ahead and post your BST with a disclaimer. I think we have enough consensus among the mods and admin who have participated so far, and the links posted by Heathah clarify this situation even further (I encourage anyone interested to skim through those).

This item is restricted only in a few jurisdictions (as such, it doesn't violate rules #10 or #11 on BST). Please include a disclaimer, though.

A little more background on which I based my decision:

A TASER conducted energy weapon is not classified as firearm by the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives since it uses compressed nitrogen gas as the propellant. Therefore, firearms-related regulations do not apply to the sale and distribution of the TASER conducted energy weapon within the United States.
...
Some states have enacted regulations restricting the sale and use of inexpensive, hand-held shock devices and these regulations also apply to TASER conducted energy weapons. In many cases, the law enforcement and corrections market is subject to different regulations than the consumer market.
